a. Under the Americans with Disabilities Act (ADA), what does Bradley need to prove to prevail on his claim of disability discrimination? 3 points) B.is Bradley likely to succeed in this case? Answer yes or no, then explain.(3 point)
Cerebral palsy limits Steven Bradley's use of his legs. He uses forearm crutches for short-distance walks and a wheelchair for longer distances. Standing for more than 10 or 15 minutes is difficult. His condition also restricts the use of his fourth finger to perform typing, but does not limit his ability to write. Bradley completed two years of college His grip strength is normal, and he can lift heavy objects. Bradley applied for a "greeter" or "cashier" position at Wal-Mart. The job descriptions stated, "No experience or qualification is required." Bradley's previous work experience included positions as a proofreader and as an administrator. Bradley's application at Wal-Mart was rejected, according to the personnel manager, based on his "work history" and the "direct threat" that he posed to the safety of himself and others. The "direct threat" was based on the belief that if Bradley used crutches on the job, he might fall and injure himself, or the space required bý the crutches might pose an "obstacle" to customers. Bradley claimed, however, that Wal-Mart refused to hire him due to his disability 2.

Explanation / Answer

a) Under the Americans with Disabilities Act, no one should be discriminated on the basis of Disabilities and in order to prevail the claim of discrimination, Bradley needs to prive that he is able to work and his disability would not hinder the work and despite this poof even if the employer does not give job to bradley then, the employer is violating the Americans with Disabilities Act.

b) yes he will succeed in this case if he proves that he can do the work and his disability wo'nt hinder his work at walmart as he meets the other requirements of the job.
