Question
natural gas leases for the recovery of deep shale rock natural gas (often known as "fracking") in the Allegheny National Forest in northwestern Pennsylvania in order to increase revenues and to encourage U.S. energy production. The DOA has not issued a FONSI or an EIS for this project. As a member of Temple University's Sustainability Coalition, you are extremely concerned with the impact of massive deep well development and gas production, and, since you are the Chairperson of the Student Action Committee, you need to develop a strategy for action. a. Do you think the National Environmental Policy Act (NEPA) might provide some relief? If "yes", why? b. How would you go about seeking relief from or review of this DOA proposal? If your strategy in “a" or "b" involves federal court litigation, how would you go about ensuring that you or your group would have "standing" to bring the action?Explanation / Answer
a) There are two type of NEPA i.e advisory and mandatory in nature. In both cases NEPA will help to provide some relief by doing research on the environmental effect and making recommendations in this regard.
b)The DOA proposal should be reviewed and it depends on case by case. If they are from where it is not economically and environmentally viable; then they should be stopped.
c) If the concerned party are not willing to follow norms or recommendations of NEPA or DOA; we can go to federal court for its implementation.
