Mall Partners demanded that ABC provide and install the signs (the Mall Partners/ABC contract required the signs). ABC's attorney, referencing the conversation between the ABC estimator and Roosevelt, and the language in the ABC proposal, stated that the signs were the responsibility Mall Partners. Is ABC's attorney correct? Who has to provide the signs? Why? Fully explain your answer 8:13

Explanation / Answer

From the brief narrative provided in Question ,following emerges:

1. A contrct has been signed between Mall Partners and ABC to execute certain works. The contract provides for provision and installation of construction signs by ABC.

2. ABC commenced the work but did not provide construction signs.

3. Mall Partners demanded that ABC provide and install construction signs as it is part of contract.

4. ABC attorney then referred to a conversation between ABC estimator and Roosevelt(who is Roosevelt is not defined in the question) and the language in the ABC Proposal to say that the signs were the responsibility of Mall Partners.

5. As per contract Law ,verbal conversations have no relevance and the ABC proposal is defunct once a contract has been signed .Therefore any reference to them by ABC attorney is faulty.

6. The work has to be done as per contract and so ABC is to provide and install construction signs.
