The terms of the shipping contracts are as follows: • Sedan contract terms: o The term is five years. o MV Manhattan, a ship in Atlantic’s fleet, is dedicated to shipping Auto’s Sedans for the term of the contract. o Auto determines (1) which European ports receive shipments and (2) the order in which deliveries are made to the ports; Auto instructs Atlantic accordingly. o Auto has the option to send the ship below capacity. Under the contract for Sedan, Identifiable asset is MV Manhattan. This ship is dedicatedly used by Atlantic for shipping of Auto's Sedan Cars. As per the terms of the contract, this ship will be used for shipment of Auto's sedan car.
Under Luxasry car contract, there is no identifiable asset, as Atkantic is free to choose the ship and timing of ship with in the given range of deadline as provided in terms.
2. Under Sedan Contract, Atlantic is working under contol of Auto. Even in case of under utiized capacity to ship, Atlantic can not ship other customers shipment in this ship. All the shipment is monitored and controlled by Auto and Atlantic workd under the guidance of Auto for Sedan car shipment. Auto determines which port in Europe shipment will go. The order in which delivery is made, all decided by Auto.
This shows that Auto has the right to control the use of identified asset.
