Was Simpson found guilty for his alleged crime? What type of Tort Simpson committed? Was he found liable? What are the elements of Simpson's tort? What is the difference between a tort and a crime? Explain your answer by giving an example.

Explanation / Answer

1. Plaintiff - families of Nicole Simpson and Ron Goldman; Plaintiff - OJ Simpson

2. Initially, Simpson was not found guilty and aquitted of all charges but later on, he was found civilly liable and was ordered to pay $200 million in damages.

3. Simpson committed an intentional tort (tort of wrongful death). He was found liable and was fined. The elements of Simpson's tort are - Wrongful death which was intentional and lower evidence requirement in civil trials as compared to criminal trials due to which he was fined.

4. A tort is a civil case proceeding which is a wrongful act that interferes with another person or property while a crime is a criminal case proceeding which is a wrongful act according to the state or the federal government. For example, a person who gets knocked down unknowingly by another person can file a tort case but not a criminal case against him. In a tort case, the plaintiff would bear all the costs while in a criminal case, the state would be liable to bear all the costs of the trial.
