You own and operate a gay gentlemen’s club in Illinois. You have well over 35 full time employees. You only hire straight men under age 30 as erotic dancers to 1) avoid patronizing between the workers and customers and 2) because you believe older erotic dancers are not appealing to customers. Jim, a gay man, age 34, with substantial experience as an erotic dancer, applies for one of the two jobs for erotic dancer you have open. Cheryl, a straight woman, 42 years old but who looks 25, with substantial experience as an erotic dancer, also applies for the job. All other applicants are straight men between 21 and 30, but none have any type of erotic dance experience. Jim and Cheryl are the two best qualified applicants for the jobs. Can you refuse to hire Jim and Cheryl? Be sure to identify all applicable laws and discuss how the laws apply or do not apply to this situation

Explanation / Answer

Based on their experience I couldn’t refuse Jim and Cheryl because out of all the applicants they are the ones with more experience on the industry.

Even though most of our staff are straight men under 30, I believe we could give an opportunity to them.

The reasons why we hire only straight men under 30 is to avoid problems and to attract more customers but anyone older or gay could perform the tasks if they have the skills.

If I refuse to hire Jim and Cheryl because one if gay and the other one is a female they could file a law suit with the Equal Employment Opportunity commission because I am discriminating them based on their sex, age and sexual orientation.
