Should JJ Be Hired? Jason Jay ("JJ") Nelfert was optimistic. He had just applied for a job as a police officer at a university with about 25,000 students. Based on the job specifications, he was confident that he had the right qualifications. In addition to his bachelor's degree in criminal justice, he had completed the regular training at a local police academy. The 3 years working in a small police department (two full-time officers, one part time) had also given him good experience. He earned high performance appraisals and was sure to get a good recommendation from the police chief. Moving to the larger six-person police department at the university was a nice progression for his career. He thought that he was at the right stage for being 27 years old. JJ had sent in his application and resume, complete with references, and had gone through an interview. He was waiting to hear the results. A letter arrived in the mail felling him that the university police department would not be hiring him. He contracted the university personnel office to seek information about why he wasn't hired so that he could take that into consideration when applying for a job elsewhere. He was told that he was not hired because he had multiple, large, visible tattoos. JJ was quite shocked. "What does that have to do with doing a good job as a police officer?" Besides, the tattoos would be mostly covered, especially if he wore a long-sleeved shirt. Yes, but they would be visible when he wore short sleeves or shorts. Some were slightly visible above the collar and on one wrist. The director of Human Resources told him that the tattoos were not professional. JJ had the opposite view. Is the university´s decision to not hire JJ appropriate? Is it legal?

The decision was not appropriate because it was based on the fact that JJ has tattoo on his body, this can be consider as racism and it is not legal according to the Equal employment Opportunity Commission, in fact JJ could file a law suit against the university.

What does appearance have to do with doing a good job?

Nothing actually. Some people might consider tattoos inappropriate to conduct certain jobs but I don’t think it influences it at all. JJ was clearly qualify for the position based on this experience.
