Question
With handeling Regulatory Intent,
You are responsible for auditing the hazard-communication program at a site in the United States.
In reviewing your regulatory database, you note that the training provisions of the regulations “require that employees shall be informed of the location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals and MSDSs required by this section” (29 CFR 1910.1200[h][2]).
In interviewing four employees, you note that each is able to tell you where the nearest MSDSs are located. Moreover, when requested, each is able to locate a specific MSDS for a fairly obscure water treatment chemical and knows how to “read” the MSDS. However, when you ask all four employees where they might find the written hazard-communication program, each and every one looks at you with a blank stare.
Do you have a finding here? What will you do you the Business Organization and Employee's?
Explanation / Answer
MSDS is material safety data sheet which contains sufficient information about potential hazards and how to work safely with chemical products. When the written hazard communication program is not available, the data from msds can be used to find the hazard communication.
