Let's try this exercise to discuss sentencing and a judge's discretion. The idea is

to look at the range of sentences we get from our class. There is no wrong or right

answer.

This is the case before you this morning:

Two 18-year-olds, Al and Bam have affections for the same female.

The two young men meet each other and have an argument over her.

As they each turn away from each other to leave, Bam punches Al in the eye, knocking him out. As a complication, Al loses the sight in his eye.

Bam has been convicted of aggravated assault, has no criminal record, is going

to CCP and getting his education, works a part-time job and has a supportive family.

In a victim impact statement, Al states he has struggled with the loss of sight in his one eye, dropping out of school and losing his jobs since he cannot operate a motor vehicle.

Please issue your sentence.

Short and sweet----incarceration? probation? a fine?

Explanation / Answer

Is Bam a criminal? No. Has he broken the Law. Yes. Has he grievously injured a person, due to which there is aloss of capability to earn? Yes. Guilty. There is always a first time. A first time murderer cant be let loose, similarly Bam too has to pay for assault. Incarceration along with a fine.
