Scenario 2 Six months ago, a customer testing a treatmill sold in one of the retail stores was injured when the machine stopped abruptly and threw the customer into a wall. During a review of the discovery documents, it was determined that Dee Structionan employee of Walexron, deliberately tampered with the machines in retailation for being passed over for promotion to store manager.

Yes, Walexron is responsible for the actions of Dee Struction. Walexron is the retail unit responsible for providing quality assured products to its customers.

The quality assurance comes from 2 sides - the manufacturer/wholesaler provides 1 level of quality assurance which ensures there's no manufacturing defect. The other aspect of quality assurance comes from the retail store, that in the period the item/unit was in the retail store, there has been no sort of damage. In the above scenario the damage was caused inside the retail space of Walexron, and thus the retail store needs to take responsibility of the outcome.

Now coming to the fact that the accident was caused due to an employee of Walexron and not by Walexron, however we need to understand, that Dee Struction was on the payroll of Walexron and anything that Dee Struction does during the working hours within the retail space represents actions of Walexron and thus the actions of the company. Walexron can choose to take a suitable legal action against Dee Struction on a separate note, but Walexron is fully responsible for maintaining the quality assurance that it promises to customers and thus in this situation will be responsible for the actions of Dee Struction.

The matter regarding 'passed over for promotion' might require a separate investigation to check if there are any organizational flaws to ensure there is no future cases of disgrunted employees which can increase attrition for the company, however in light of the given question, the given situation will not be required to analysed as its a separate and independent issue.
