Ans 1) As per Tracey Thurman, the Police practice used in a discriminatory fashion in her case was providing insufficient protection or even no protection to Tracey (being a woman) when she was continuously threatened by her husband. The police failed to provide adequate protection to Tracey and also failed to arrest her husband for assaulting her despite of several complaints made by her.

Ans 2) Since the case was filed against City of Torrington so the justification was not directly given by the police department in this case and it was the city which offered justification providing that as it was a domestic matter and as per equal protection clause of 14th Amendment police protection can only be provided if a victim is abused by any unknown person.
