Write a short essay (approximately 200 words) discussing the difference between civil and criminal cases. This is important because this course looks at civil liability, though criminal issues sometimes arise. The case your watching is a criminal case brought against the police officers in the King case for excessive force, but much of the information is relevant to a civil liability case (evidence would be much the same in each kind of case). Be clear and thorough in your comparison and contrast. Be sure to discuss the difference in the burden of proof for each kind of case.

- Criminal law is the system that focuses on acts against society. According to this system, it is the government that should take the responsibility for pursuing criminal matters through law enforcement officers as well as prosecutors. The focus of this system is that offenders should be punished such that a societal sense of justice could be maintained. Criminal cases are the ones that are generally offences that are committed against the state. This is mostly considered against the society or the state as a whole, an example is murder. Crimes that would be committed against the state would prosecute, and a representative of the state files the cases. In these cases, crimes have to be proven well beyond a reasonable doubt.

- Civil law is concerned with the private rights and remedies, which may not be necessarily for the good of the public. If there is a violation of civil law, it is considered to be wrong against an individual. Civil cases are the ones where there are disputes that occur between people about the legal duties or the responsibilities that they must carry out against one another. Whereas, in a civil case the party who has been wronged would file a case. In civil cases, there have to be lower proof standards “ the preponderance of the evidence”. Civil liability, is comparatively less on the scale of blame and are also considered with less severe punishment.
