Vincent sends Butch an email offering $200 for Butch to "clean my house." Not knowing Vincent has 2 houses, Butch looks up Vincent's address on Facebook, and cleans that house. After cleaning that house, Butch sends Vincent an email with an invoice attached for $200 for "house cleaning." Before receiving Butch's email, Vincent goes to his rental house that he wanted Butch to clean, and finds it still dirty. Vincent calls another cleaning service, and pays $300 to have them clean it that day. Upon checking his email later that evening, Vincent finds Butch's email, and deletes it. Butch sues Vincent for payment. How will Vincent defend? What claims will Butch assert? Who will prevail?

How would Vincent defend:-
Vincent would clearly say that before asking for any further details Butch provided service where it was not even needed. If they were the service providers, they should have asked about the entire information before providing the service. There was no information message/ call niether there was any acknowledgment email/call confirming about the service. Even if Vincent have written an email to clean the house, service provide should have asked about details confirming the address & contact info rather than assuming the address on facebook. Facebook could have obsolete information. Not even after cleaning the house they made a call, they staright away sent an invoice. Vincent could have negotiated for cleaning with the another house with Butch itself, since they have cleaned the another house. Lack of communication; improper way of acknowledging the service; No customer interaction while performimg the services are major reasons basis which Vincent can defend himself.

Butch can assert:-
Since i have performed my task as stated on email, Vincent has to paythe amount since the service has been offered. Incomplete information was provided by Vincent so we made our research & found the house of Vincent & cleaned the house. Since we have cleaned the house & performed the activity Vincent is bound to pay the amount to us.

As per service industry & norms, customer is supposed to treated like a guest. Customer is paying vendor for their services, customer could not be vigilant/ know of information that is supposed to be provided prior taking service. This is the wholesome responsibility of the vendor to inform/ask about any information that is needed prior performing the services for their customer. Customer might not have insight what could be the variations in the service if any information is not provided. Vincent will prevail since he has not been informed/ confirmed prior making any services to him neither any confirmatory email/ message/call has been made prior cleaning the house which he didnt even mentioned. Butch took information from social media & performed the services without even confirming from Vincent. Butch should take lesson from this & should not make such mistake in his business ging forward.
