You are concerned that the politics around judicial selection will decrease the legitimacy of the courts and will make it far more difficult for courts to 1) act as a check on an oppressive majority and 2) act as a check on the other institutions.
Explanation / Answer
Federal and state judiciary are based on philosophy of separation of power . Though this separation is not water tight , there must be relative independence of judiciary . It is because of the fact that judiciary not okays critical role in administration of justice but also act as a pillar in ensuring proper checks and balances on legislative and executive function and functionaries.
Recent controversy over executive interference in appointment of judges, thus , appears to be a critical subjugation of independence of judiciary and this needs to be resolved through deliberation and negotiations.
