PATENT: It is a set of exclusive rights granted by a government authority to an inventor for a certain period of time in exchange for detailed public disclosure of an invention and excludes others form making, using or selling the same.

Eg: Lore Greiner started her career by creating a plastic earring organizer which could store 100 pairs of earrings. She took a patent and sold many copies. She followed the success with 600 other inventions and is now called the patent queen. She is one of the sharks on “Shark Tank” – a reality show in which the investors invest in new & interesting business ideas.

TRADEMARK: It can be a symbol, emblem, logo, design or words legally registered by a company to identify its products or services.

Eg: The name “Google” and the way it is designed is a trademark of that company. Google stands for Global organization of oriented group language of earth. This word itself carries 27% of their brand value.

COPYRIGHT: It is a set of legal rights owned by a creator of original work for a fixed number of years to print, publish, perform, film or record literary, artistic or music material.

Eg: Copyrights of Film and its name by the filmmakers, Copyright of a book by its author, music videos by the production house etc.

Summary of the facts and court's holding in a recent patent infringement case :

Apple filed a suite of 4 design patents and regarding the basic shape of phone on Samsung. After several trials and repeals the court announced in favour of Apple in the year 2017 and fined Samsung to the tune of $120 million.
