Using complete sentences, in a short paragraph answer the following questions (5 points each). I will provide comments back to you on your submitted assignment:
1) The length of time for protecting copyrighted material is lengthy. Briefly describe that protection period and why a teacher might be able to make copies for a classroom without paying for royalties.
2) A maintenance person at a bank who only has cleaning responsibilities after hours found a teller's drawer unlocked. He dishonestly takes money out of the drawer. Is this embezzlement or larceny? Why?
3)The video Spying on the Home Front points out a challenge regarding our criminal justice system when we are trying to stop the terrorist act before the terrible act occurs. Briefly explain this challenge.
4) Please read this set of Facts:
CyberConnect, Inc. is an Internet service provider (ISP). Pepper is a CyberConnect subscriber. Market Reach, Inc.is an online advertising company. Using Sophisticated software, Market Reach directs its ads to those users most likely to be interested in a particular product. When Pepper receives one of these ads, she objects to the content. Further, Pepper claims that CyberConnect should pay damages for "publishing" the ad. Is the ISP regarded as a publisher and therefore liable for the content of Market Reach's ad? Why or why not? Explain what is meant by the term "online defamation."

Answer 1: The copyrights are governed by the Copyright Act of 1976, 21 as amended. Any work published or done or created after 1978 are given statutory copyrights protection for lifetime of author plus 70 years. The publishing houses owns copyrights which expires after 95 years starting from date of publication or 120 years from date of creation whichever comes first.
Under the "Fair Use Exemption" which is copying of any copyright material done for a limited and "transformative" purpose , the teacher can make copies.
Answer 2 : This is a case of larceny committed by the maintenance person. Larceny is the theft of personal property without any force or fear. In this case the money in the teller's drawer were the property of the teller and she is accountable for the drawer and its content. Hence, the maintenance person took teller's property unlawfully making it a case of larceny.
Answer 3 : United States Foreign Intelligence Survelliance Act of 1978 prevents the civil liberties infringement by the nation's intelligence agency. While trying to find out the communications of the terrorist among the civilian channels, not to infringe the civil liberties of the citizens is the challenge that is pointed out. Under the above stated Act, law was made that there will no wiretrap on any citizen in the U.S. without any warrant. Hence the authorities are bound by the legal aspects of not infringement of civil liberities or owning a warrant to find or keep a survelliance on the civilian chanels used by the terrorist.
Answer 4 : No, the ISP CyberConnect is not liable for the content of Market Reach's ad. The Market Reach is liable for the content as they are the one who choose to use the software of the ISP to reach out to their desirable target audience and hence the ISP is not responsible for the content of Market Reach's ad.
