Computer Laws"

Please respond to the following:Describe the various levels of penalties that someone can face for breaking the following laws including the Computer Fraud and Abuse Act of 1986 and the Florida Criminal Use of Personal Identification Information. Compare and contrast the penalty levels faced by each law.

Explain whether you believe the laws mentioned previously are clear and specific and whether the punishment levels are appropriate for individuals that break the law. Suggest a recommendation on how the law can be modified to deter this criminal activity.

Explanation / Answer

The Computer Fraud and Abuse Act of 1986 has many degrees of penbtalities. These can range from fines, ten to twenty years of imprisonment or both, depending upon the degree of violation, or how much was stolen. A person who violates the
Florida Criminal Use of Personal Identification Information, can recieve anywhere from a minimum of three years in prison and fines to ten or more years for more elaborate crimes, as well as fines if not both. Both laws have about the same penalty levels. It really just depends on how big the felony is. Either way the penalties of these laws can be more than enough of a punishment for the criminal.

Yes the punishment levels are appropriate for the criminals, perhaps a little extreme in some cases but fair. These laws can be modified to deter criminal activity by perhaps increasing the sentence time or the fine amount leading to a stricter system with less violence, however even with such changes crimes will still occur so it's best not to make the penalties to high as support for such prisoners will come straight out of the tax payer's pay check which would not exactly be fair.

Hope this helped, good luck with your work!
