Question
Jessica Stamm was 16 and an aspiring model. She went to New York City to get representation in that market. During the trip, she entered a modeling contest and won. As a result, she and her mother executed an agreement with NY Models to be exclusively represented by the agency. After a few months, the relationship soured. She wrote stating, "any agreement that I may have entered into, or which may have been entered into on my behalf, with the New York Model Management" is disaffirmed. Can she avoid the agreement? Explain why.
Explanation / Answer
She can avoid the agreement but that depends on the clause and terms and conditions of the agreement that is mentioned. If there is a duration clause in the agreement and if the tenure is not yet over then she cannot avoid the disagreement but if there is an exit clause mentioned in the agreement then she can but she has to fulfill the requirements of the exit clause, that may include penalties as well. If there is no exit clause then she cannot avoid the agreemnt as per her will, in such a case the other party has to provide her with a no objection certificate which will state that she is no more entitled to the agreement but if the other party is not willing to end the agreement then she might have to continue.
