In addition to their normal hours of work, elec tronic technicians at a power plant were required to remain on call from 4:30 p.m. to 7:30 a.m. on Monday through Friday and for twenty-four hours on the weekend. While on call, the techni- cians typically responded to three to five alarms per evening. Each alarm took, on average, about forty-five minutes of work. Technicians were expected to respond to alarms within fifteen minutes. Failure to respond was grounds for discipline. The technicians were given pagers, but these did not work properly, forcing the techni cians to remain at or near home. The technicians were paid for the time they spent responding to problems, but not for the remainder of the on-call time. The technicians sued for unpaid overtime. What should the court decide? Why?

Court Decision - Based on the above working timings, the court decided to paid the technicians for the time they are engaged by the employer. The employer needs to pay the technicians as per the timing they are working / engaged by the employer.

The reason for Court Decision - The technicians are required to be on call for a long time, so they need to be paid for the same time, as they can not perform any other work during the on-call time. There is another penalty if the problem is not responeded with 15 minutes, Technicians will have penalities. So basically the employer has engaged the employees for a long time and not allowing them to perform other task or can not use that time for their other activities while on call, so the employer needs to pay the technicains for the time they are engaged.
