Sherlock approached Mr. Pilot, who by then had finished loading the aircraft, and had closed the cargo door. Sherlock asked Pilot what he was loading into his aircraft. Pilot said it was an exotic plant that could not be exposed to daylight. Sherlock asked Pilot if he could search the aircraft but Pilot refused. He said he had a schedule to keep and needed to be at his destination before daylight. Sherlock shined his flashlight into the aircraft through the window and noticed that the exotic plants were wrapped in clear plastic bundles. The small window of the aircraft near the pilot’s seat was open. Sherlock put his nose to the outside of the open window and said he smelled an odor he recognized as marijuana, even though the plants were wrapped in plastic. He then opened the door to the aircraft, removed and opened one of the bundles. He confirmed that the plants were marijuana. He placed Mr. Pilot under arrest. (a) Is the evidence admissible against Mr. Pilot in a criminal prosecution for possession of a controlled substance? Why or why not?

Mr. Pilot can be convicted for the possession of controlled substance. Controlled substances are normally drugs which are illegal to possess other than by government of USA. Marijuana is an illegal drugs which cannot be possessed by any US citizen, if found in more quantity the person can be arrested for the possession of this illegal drugs.
When Sherlock piped into window of airplane he smelled marijuana and when he torched inside he found many packed packets which was possessed by Mr. Pilot so based on that illegal possession he could be convicted and prosecuted. Under law of Narcotics Drugs and Psychotropic Substances Act of US government he will charged and preosecuted.
