Rock Hotstuff, the pilot of your company aircraft, was at the local pub partaking of some alcoholic refreshment and enjoying the company of Ms. Goodie Twoshoes a Sunday School teacher he had just met. After a few drinks he informed Goodie he was a pilot and asked her if she would like to see him fly. She agreed and they went to the airport and went flying in the company aircraft, a Mini-Belchfire. In trying to land at the airport at night, Rock mistook the mall parking lot for the airport. In the resulting crash he damaged himself, several cars and Ms. Twoshoes. She sued Rock and your company. How should this case be decided and why
Explanation / Answer
The court would order for investigation based on the complaints by Ms. Twoshoes and if the alcohol test result reveals the use of alcohol more than the allowed limit, Rock will have to undergo strict actions. The pilot license of Rock would be revoked by FAA and he may lose his job in the company. He will have to provide monetary damages to compensate for the injuries suffered by Ms.Twoshoes. The company also has to pay for the damages as the injuries are caused by the company aircraft and for allowing the employee to use the aircraft for personal use particularly after alcohol consumption. Pilots are obliged to ensure the safety and security of the passengers travelling in the aircraft. Flying the aircraft into the sky, navigate it safely to the destination and then landing perfectly are very complex task performed by the pilots and it should never be done under the influence of drugs. Alcohol can affect brain, eyes inner ear which is very crucial for a pilot. The pilots are not supposed to fly the aircraft before a specified time after lat drink and in most of the countries it is eight hours and many air lines follow twelve hour rule to make it stricter. The companies should ensure public safety and it also holds responsibility for the employee actions. Hence the court would make the judgment in favor of Ms. Twoshoes and company and Rock need to pay for the injuries.
