Tony, the general manager of a 350-room hotel, was becoming concerned as he read an email from his company's attorney. Despite having been terminated for well-documented insubordination and job abandonment, a former housekeeper named Tracy had lodged a wrongful termination complaint alleging that Tony had subjected her to gender and age discrimination, illegal pay practices, and retaliation for having protested unsafe working conditions.

As he began to collect and review the data in Tracy's employee file, Tony knew that the outcome of the case would be determined based on the quality of his record-keeping in four of the most important categories of labor law including discrimination, pay practices, employee safety, and retaliation.

If Tracy was a member of a union, how the situation was changed?

Explanation / Answer

In the given case, we can observe that inspite of providing a well documented insubordination and job abandonment highlighting the gender and age discrimination, illegal pay practices and unsafe working conditions in the hotel, Tracy was still terminated by the Hotel. Tony, the general manager of the hotel was confident that the management of the hotel will not change its decision on the basis of the wrongful termination complaint by Tracy against Tony, given his solid record keeping in the important categories of labor law.

The situation would have been completely different if Tracy was a member of the Union. A labor Union is an organisation which acts as a bridge between the organisation and the employees of the organisation. The labor union comprises of the employees and it gives them collective bargaining power against the organisation that employs them. Here, Tracy found herself alone and helpless against the powerful management and human resource department of the hotel. If she was a member of the union, union members would have fought for her rights and would have collectively bargained with the hotel management on the shortfalls in policies regarding gender and age discrimination, pay practices and workers’ safety.

When an employee is a member of the labor union, the union representatives work on behalf of the employee even if its a personal issue of the employee with the employer. Since, Tracy was not a member of the labor union, she felt vulnerable against the general manager Tony and the Human Resource department of the hotel.
