Madelyn Thomas, a minor ( age 19 months) was injured when her fingers came in the grip of opening of an operating paper shredder, while she was playing with her mother at a place where shredder was installed,. The plaintiff sustained severe injury in thr process. Staples Inc, the manufacturer of the machine was sued for  claims for strict liability, negligence, breach of express warranty, breach of implied warranty, and compensatory and punitive damages for manufacturing flaw in the machine that led to the accident.

Plaintiffs alleged that the injury was caused by faulty design of the machine produced by the company, whereas the manufacturer and seller claimed that it was due to parents' negligence, because they must be aware of the consequences of a child's vulnenrability to the injury if she cames in contact of the machine, as they ( parents) had read the warning pasted on the front of the machine.
