Question

The U.S. is at odds with many other countries over laws concerning online gaming (Rushe, 2011). In the U.S. online games that involve gambling are against the law. In Britain, online gaming is a lawful industry that is taxed and regulated.

The U.S. claim of jurisdiction over online gambling is based upon the rights of nations to regulate the behavior of individuals and businesses operating within their borders. In early 2011, the U.S. continued enforcement of its laws against online gambling by seizing assets (Internet domain names) belonging to non-US gaming firms (Rushe, 2011). Federal law enforcement agencies (FBI & Department of Justice) also obtained U.S. court orders freezing bank accounts used to transfer earnings between offshore gaming activities and U.S. banking institutions.

Britain and other Common Wealth nations (notably Antigua and other small island nations) have repeatedly complained to the World Trade Organization that the United States is violating international trade agreements by interfering with their rights as sovereign nations to promote, regulate, and tax online gaming (Gossett & Sutcliffe, 2007; Rushe, 2011).
