Sleepy, who had worked at Skinny's for 10 years, comes to work every day about 5 minutes late. Last year he won "Employee of the Month" 3 times, which entitled him to a special parking spot on the lot. Skinny's hired a new manager, who made comments to the effect he did not like Sleepy's constant yawning and found him annoying. He fired Sleepy, stating his lateness would not be tolerated under his leadership. Can the new manager do this without any fear of legal consequences?

Sleepy Dwarf an efficient employee of the Skinny's Food Market is working for the organization for the last 10 years and has been a performer in his tenure due to which he has won the "Employee of the Month" award thrice in the last Calendar Year and as he was also provided a special parking lot in the office parking premises as an achievement. Skinny's food market starts its operation from 8:30 AM in the morning but Skinny is generally late for minutes but he compensates this five minutes by working hard which is very obvious from his achievements.
Like all other business organizations the objective of Skinny is to generate maximum possible revenue and this depends on three stakeholders namely the employee, employer and the customers or clients and the well being of all the three stakeholder will assure betterment of the organization. In order to make the employees feel better the Human Resource department of the organization has handed out an employee work book to its employees which states that employees may will only lose their job if they provide a very strong reason to the organization which may lead to termination. This infers that the organization actually looks after its employees.
A new manager is hired and he terminates Sleepy stating that sleepy is generally late and his constant yawning is annoying. The new manager can do this but is sleepy seeks legal help, then the manager will be in trouble because the United States Department of Labor does not allow the manager to do so and even is there is organizational policy it should abide by the United States Department of Law.
The United States Department of Labor and the United States Corporate Law promotes and believes in fair trial before a termination is announced. There is a proper process to that an organization needs to follow while dealing with late coming employees. Initially the employee has to be warned and also monitored, if the activity is repeated again the seriousness and degree of the warning needs to be more and the person should be aware of the seriousness of the issue. Even after a series of warnings and a final warning if the activity is repeated the formal in disciplinary letter can be handed out to the employee which will be forwarded to the disciplinary team and will be analyzed and then if it is decided that the employee is guilty he or she may be terminated or any other strict measures can be taken. If any employee is terminated without violation of any non negotiable guidelines of the organization, the employee may file a lawsuit or seek legal intervention
