Question
The car was used and sold to ingram, while purchasing and selling used items the law is diiferent from that of new items because of obvious reasons. Here Ingram was aware that the car is used and generally used items follow the law of "as is". the term As is refers that the the seller is selling the item based on the present condition of the item and the term is also a significant notice for the purchaser that he or she is ready to accept the risk related with the product. If any issue in the performance or quality of the product is noticed after the transaction is done will not be entertained by the seller and legally the purchaser cannot clain any service or remuneration for the same.
The issue with Ingram is also the same where the product was sold based on the As is law which was mentioned in the sales slip which he missed or did not pay attention to, therefore in this context the seller cannot be blamed. Ingram was not informed vocally but he should have read the terms and conditions mentioned in the slip carefully and could also have taken expert advice because during a transaction some terms are very important and needs to be evaluated carefully. Ingram failed to do so and hence the consumer protection law is not vilated in this context, the seller could have been vocal about the As is law which could have been ethical but the deal is legal and valid without any violation.
