Yes, information collected from the onboard computer can be used against the convict, but warrant should be issued to investigate the content of the onboard computer of the car.

As per the guidelines of the NHTSA (National Highway Traffic Safety Administration), the onboard computers in the car should be treated as black-box of the car and provide the valuable information such as the speed of the car, the time duration of pressing the accelerator and, the condition of the driver wearing safety belt or not, among the other information. These information will be retrieved from the onboard computer and studied to identify the state of accident and the role of the driver to establish the crime.
