New Store, and some employees, including Max, are against the union. Who can demand that a union election be held, and how? If the union is elected, does it have to represent Max? If the union is elected, does New Store have to bargain over overtime pay and the times that the plant opens and closes with only the union, or can it bargain with other employees?

If the union is elected by the majority of employees and is also certified by the national labour relation board, then it must represent all the employees including those also who did not vote for them. yes employer can bargain with the union over the terms and conditions of the employment like overtime pay , time to open and close of the store. it is the duty of the union to bargain fairly on the behalf of the employee with the employer . the union election will be held if 30 percent of the employees support it, as it is shown by their signature on the authorization card or the other evidence that shows the amount of support.
