Ms. crossed out the clause giving them an option to buy. She added a sentence at bottom, saying, "Should I, Lillian Whatlev, decide to sell at end [sic] of three years, I will give the Dukes the first chance to buy." Then she signed the lease, which the Dukes accepted in the changed form. They continued to pay the rent until Ms. Whatley sold the land to another couple for $35,000. The Dukes sued. Duke Sued for the land sale case.

Duke has sue the case , as Duke had a lease contrat with Lillian Whatley, which says that if Lillian Whatley decided to sale the land at the end of lease contract, then she will give the option to Duke for purchase. As per the contract signed, the Lillian Whatley needs to give the option to Duke to purchase the land, at the end of the lease contract. But Lillian Whatley had already decided to sold the land before the contract ends, then there is no liability of Duke on this sale as per contract, as Lillian had not sold the land after the lease contract, but bfore the lease contract. The decision will not be in favor of Duke. The decision will be in favor of Lillian Whatley.
