Explanation / Answer

Answer

Unfairness or inequality in the workplace in an organization: It is defined as the act of extending special treatment / benefit to an employee with ignoring the interest of other employees in the work place. Or taking a decision for the interest of one particular employee without following the common process of decision meant for all employees. Unfairness or inequality means observation of taking a decision which is not fair with respect to the interest of all the employees.

Unfair Case in Organization: Internal Job Posting an organization: We have seen that in the process of internal job posting in an organization, the fair or equality processes are not followed. The candidates are selected based on personal attachments/friendship/relatives/common groups etc. The employee in the organization has a common believe that internal job posting process is unfair process, in which candidates are not selected fairly, the candidates are already fixed and the process is used to formalize the selection. The pre-selection of candidate is based friendship, personal contact, relatives etc.

Implication on Organization - This unfair process has the implication on the organization that the HR process of internal job posting is unfair and an example of inequality in the organization. All employees believe that the equal opportunities are not given to all employees for their career aspiration. In order to get the selection, an employee needs to explore unethical means like develop personal relation with selectors etc. This does not allow to more forward the right skill set in the organization. The deserving candidates will be not selected. Hence it will impact the future of the employee as well as future of the organization.

Act of unfairness: As per fair process, the selection of candidate should be with respect to the written process and the interview, but the pre-selected candidate is already groomed for the written test. He got extended support in the written test by the selection team. The pre-selected candidate is managed by the selection team to clear the written test. Post written test, during the interview, the special ranking is allotted to the pre-selected candidate. Finally it is declared that the pre-selected candidate is selected for the internal job posting.

Duties and responsibility of Human Resource Professional and attorney representing the organization : The duties and responsibilities of human resources professional is to develop the platform for fair and equal opportunity HR processes in the organization so that all candidates get the equal chance of getting selected in the promotion or internal job posting process. This helps the organization to drive the right behavior and finally benefits in terms of taking forward the right skill set, which will help in the growth of the organization. The role of attorney is to ensure that the HR professional is maintaining the fair and equality process in the organization. He needs to have the review mechanism and needs to validate with views of the employees in the organization.

Compare and Contrast: The purpose of both HR professional and attorney of the organization is same that both need to work for the common goal of having fair and equality processes in the organization. But their responsibilities are different. The HR professional needs to develop and maintain the fair processes at the organization. While the attorney or the organization needs to ensure that the fair processes are maintained. The attorney needs to explore the ways like have the survey method or personal interaction with all employees to ensure that the fairness and equality is maintained in the HR process in the workplace.
