Explanation / Answer
a) We can assess the principal action that he might have informed to police to get cognizance of the issue.Whether sharing a medication is illegal or legal and in case if receiving students got affected,assistant principa doesnt got charge of the harm.
b) We can think on both side of his action.
His Action is not justified because he could have solve the matter internally as well.Because there is only showcase of presription.The students has not taken the medication.So Principal should have clarified to the students that its not good to share her prescription with somebody else.
However His Action is justified also just in case the student took that medication,it could have done harm to the student.So It was good on part of principal to acknowledge the matter with the police.
c) Yes Other options were available to principal.He could have solve the problem in many ways without moving to police.Some options may be-
1-Principal should have clarified the harms of taking other medication to students.
2-He should have inform there parents so that they can aware there childrens.
3-He Should have warn them and at the same time started a campaign so that no such incident could occur in future as well.
d)The Child with disability has only shared her prescription with the principal.She has not compelled the student to buy take the medications.So In case police go to further query she wold have explained them saying that she was just discussing.
e) Courts should have viewed this with a good step by school principal because they are atleast aware of the harms of taking another medication.And by complaining to police,they have aware the police.
f) The Individual and Disabilities Education Act(IDEA),Section 504 of rehabilation Act South Carolina tells about the procedings regarding school suspension or explsion for special needs students.
g) Least Restrictive Environment means that Federal Laws give the right to students with disabilities receive there education,to the maximum level appropriate with non disables peers and that special education students are not removed from the class unless with supplementary aids and services,education in regular class cannot be achieved satisfactorily.
h) Although "Mainstreaming" and "Inclusion" are used interchangeably but there is a subtle difference between these two.
In Mainstream Education the disable stuudents technical aspect of instructions and assessment remains same but In Inclusion Educaion system,though Students with disability are going with there peers in classes but they are given some relaxation in terms of technical and assesment aspects.The Curriculum is often completely rewrittenn for the included students so that he will have the capacity to pass the assessment and gain the confidence in his skills,even if his not performing anywhere near to his peers.
