Providing licenced software to customers by taking substantial amount per user without having particular permissions and without following specific guidelines it will be a big problem for the company.
It will be a serious ethical and as well as legal issue. To avoid that legal issues and to avoid problems the company first need to take patent rights on that software.
This patent rights tells that the software is the company's own and original product. So that now they will be the official owners and they can provide licence to the customers.
