What is the best potential theory of discrimintaion for a plantiff to pursue? Lian, an American of Chinese decent, is employed as an architect in a large regional firm. His evaluation by his superiors have been mostly positive for two years with the consistent exception that he arrived late for client meetings, on a frequent basis. On one evaluation his superior wrote, "I thought Asians were supposed to be efficicent. What happened here? " One month later, Lian is denied a promotion based on his record of " tardiness and other general considerations.

I believe that the issue being discussed in this context is not discrimination, instead it can be considered as an event in which an employee actually does not adhere to the rules and regulations of the organization, based on which there is a comment made by the supervisor that involves the ethnic origin of the individual although the comment is somewhat positive based on the ethnicity factor which Lian is unable to follow or replicate. I believe that the statement made by the supervisor is a positive statement about the ethnicity of the individual and he also cannot deny the fact that he has been cominh late to office on a frequent basis.
