The federal aviation administration is the national regulatory authority within the United States for regulation of every aspect of Civil Aviation including Air Traffic management all certifications with respect to aircraft and recruitment of personal along with protection of all related United States assets during launch or reentry of commercial space vehicles. It is also responsible for construction and operation of all airports. The federal aviation act of 1958 conferred the responsibility for all the safety regulations including establishment of a Civil military coordinated system of air navigation and air traffic control. Aviation security improvement act of 1990 provided clear instructions to the federal aviation authority for establishment of minimal training requirements and staffing levels for maintenance of required standard of airport security which was under the control of FAA. The information relating to security at airports is extremely sensitive and disclosure of security arrangements may render it ineffective and vulnerable to being overcome by attacks. Due to this such information is considered highly classified and accessible only to concerned officials of the highest level to ensure protection and security of citizens is not compromised under any circumstances.
The freedom of Information Act is a federal law which conferred upon the citizens the right to extract information and documents which is undisclosed. Such disclosure may be passing a complete and relate to various agencies provided that the required procedures for disclosure are followed. The act however provides exemption to nine statutes. However, president regan's executive order 12356 was enacted there by providing Federal Agencies the freedom to with hold information and the exemption one which related to National Security information on the basis that it would a food better protection and was essential to strengthen national security. This was further amended by president Clinton don't allow release of search classified documents which were more than 25 years old or of historical interest and importance.
Therefore, in spite of the freedom of Information Act allowing information to be disclosed to citizens any information compromising national security is exempt from the purview of this act. However, the FAA interpretation is not binding as the law is not bound by the interpretation of it by various agencies but needs to be followed as stated clearly. however, the disclosure of the information required would depend entirely upon whether it was institute and compromising national security or not which would be decided by the courts.
