Question

Ethical, legal and regulatory conflicts occur when conflicting values are at odds. As you read them consider a nursing home that tries to keep resident safe (safety is a values) and how this impacts a residents autonomy (autonomy is the value) in the process. A resident who is cognitively intact has a swallowing problem from a past stroke. The resident is a risk for choking is said resident eats regular food, Safety is maximized by a mechanically altered diet - the resident receives purred (baby food) to prevent choking. Autonomy is negatively impacted, because the nursing home resident want regular food and understands the risk. In addition to values being at odds, it often places the family and the resident at odds (family does not want the resident to choke to death. Regulations often put resident rights and safety as odds. Discuss this ethical, legal and regulatory conflict with the usual three comments.

Explanation / Answer

There exists many circumstances where ethical, legal and regulatory conflicts occur as highlighted through an instance. Legal rights of an individual are the basic rights that he/she possesses in a country and no one has the ability to deny the same. But not always a person is free to use his/her legal rights. In situations where a medical condition of a patient results in illness that requires him to avoid certain type of food or forego facilities like Air Conditioning etc. or an individual suffering from Diabetes is restricted from consuming sugar high foods and sweets, the family members of the patient are concerned about his/her health and deny the patient of certain things. This is ethical as far as the family members actions are concerned as they are doing it for the safety of the individual but it is a denial of the baisc legal and human rights of the individual.
