Title VII prohibits discriminatory hiring whether intentional or unintentional. In order to correct an imbalance in their workforce, a company may adopt a policy of preferential hiring. Likewise, if there is a disproportionate number of students from the protected classes, they may do the same. Discuss the impact of June 2016 Supreme Court decision to uphold the admission practices of the University of Texas and the adverse affects for non-protected groups. Please state your opinion of this case.
Explanation / Answer
The June 2016 case including Abigail Fisher and the Texas University created a quite a bit of sound and affect. The case raised various questions regarding the admission of students based on the 14ty ammendment if the constitution stating about the equal protection clause. The supreme Court's verdict raised further questions as the marhin was just 4-3 and hence there was dissent from the justice losing teh majority which created a lot of stir.
The race sensitivity admisision policies that the university follows need yo be scrutinized strictly and without proper scrutiny decisions should not be made or taken at all. The supreme Court lead by Justice Kennedy supported the fact but also favored the diversity of education that the universities need to follow as well. The structure and hierarchy of the higher education in US was at stake because the equal protection right is true and valid even for the unprotected class.
I personally believe that there actually should be equal protection right instead of a minority quota because quality is the key for a nation's success and just promoting reservation won't help. It may seem fair to some extent and in US the term reservation is actually not used or practiced formally but it's presence can be felt from such activities.
