Question

Steve worked for The Burger, a fast -food restaurant, for five years. At each performance evaluation, Steve received high marks. Steve then found out from his doctor that he had developed a rare form of cancer. During a break with his boss, Steve mentioned the diagnosis ut assured his boss that it would not affect his work ability or schedule. His boss secretly believed that Steve's cancer was contagious and could spread to the food that was served to customers. Steve's boss told Steve' s co-workers, and they harassed Steve constantly. The Burger fired Steve two weeks later. The company cited poor performance as its reasons. Steve filed suit and claimed that he was fired for having cancer. Steve also sought damages for his emotional injuries and presented his own testimony as evidence. The Burger did not dispute that it fired Steve because he had cancer, but it did dispute the request for emotional damages. In this case would the court most likely hold that an award for emotional damages? Discuss any and all ethical issues and the whether the court will award emotional damages.

Explanation / Answer

Explanation:

Yes, court would hole that for an award for emotional damages. The court would give decision in favor of Steve as he was exposed to emotional distress and his co-workers did emotional harassment regarding his diagnosis of cancer and making fun of him. This harassment is clear case of emotional distress happened to Steve and his coworker is liable for this distress.

Also there are ethical issues in this case where manager of Steve did not supposed to reveal that Steve is diagnose to rare cancer unless it affect his work and performance, which did not happened at all and another issue was that company fired him for having him dignosed with cancer giving excuse that he had poor performance which was not happened at all.
