Question
You are the chief of police. Your agency and federal law enforcement disrupted a bombing of a school by a radical fringe group. It comes to light that your officers violated the wiretap law in your state. The information from the wiretap identified the location, date, and time the bomb was to detonate. Print, radio, and television media descends on your city and demands that you defend the actions of your investigators. Realizing that your investigators saved lives would you discipline them? Defend your position.
Explanation / Answer
I would not discipline the investigators because the investigators have done a great job by helping to find the bomb and preventing explosion. It is their duty to act based on the information they receive and protect the public. If I discipline them, they may get de-motivated to do such things in future. I would try to convince the media and public by stating that the laws are there to protect the public and any activities that are intended to harm the public cannot be given same protection as others. As the wiretapping has done to understand the location, date, and time the bomb was to detonate, the wiretap law protection becomes insignificant and cannot be extended for parties and activities intended to harm the public.
