Elmar, a farmer, contracted to sell his cabbage crop to Chris Coleslinger for $495, the contract being made one week before the harvest. Their contract was entirely verbal. After the harvest Elmar quickly sold the crop to Don Trump instead for $800 when Trump called and offered to pay immediately, in cash, that day. Mr. Coleslinger threatened to sue Elmar for breach. Answer the three questions below with at least two to three well developed sentences per question. Assume the parties can prove what actually happened, ie. the facts I gave you in the case. Explanation / Answer

Chris cannot win because the contract was verbal and it was not written. There isn't any legal proof about the claim made shout selling the crop to Chris. It becomes complicated to prove anything which is not written and completely verbal agreement. It is important to have atleast a defendant who would be able to prove that there was indeed a verbal agreement.

Chris will only be able to prove it if he has any proofs like messages, emails, phone messages which backs the verbal contract. The laws that are applicable in this case are law of fraud; however this is only applicable if it can be proved.

It is important to have the quality of Enforceability which can be complicated for verbal agreement and proving the contract to can become difficult
