Question
Josh is a "runner" for Steve Shady, a prominent sports agent. While on campus at Bigtime University in the State of Missolina, Josh meets (without informing the administration of his presence on campus) with Marcus Goode, Bigtime's star running back. Goode is a sophomore and has 2 years of eligibility remaining in the NCAA. Bigtime University competes in NCAA FBS Division I. The State of Missolina adopted the UAAA in 2002. Josh represents that Shady is prepared to provide the following to Goode should he agree to be represented by Shady:
The keys to a Mercedes-Benz S-500, parked right outside Goode's apartment.
Cash in the amount of $5,000.
Training at Shady's posh Fort Lauderdale, Florida, workout facility in preparation for the NFL draft combine.
Answer the following series of questions in complete sentences:
Is the meeting between Goode and Josh subject to the provisions of the UAAA?
Assume Goode agrees to be represented by Shady at this meeting. Has the UAAA been violated, and if so, what are the potential penalties?
Assume further that Goode later signs a representation agreement. Would either meeting or the signing of the representation agreement adversely affect his amateur eligibility with the NCAA?
Assume that 13 days after signing the representation agreement, Goode has a change of heart and notifies Shady that he wants to cancel the contract. May he do so? What, if any, impact will the cancellation have on Goode's amateur eligibility?
Explanation / Answer
No the meeting between Goode and Josh was not subjected under the provision of UAAA. Josh met with Marcus Goode without intimating the administration. This was not comes under UAAA provisions. The athlete should intimate to the officials before meeting to any other athlete.
If Goode agrees to represented by Shady in this meeting, then the UAAA has been violated. According to UAAA provisions, if any athlete is signing contract with an agent before there athletics eligibility expires then this act provides the right to student athlete to cancel the contract within within 14 days. The potential penalties may be that student athlete would be in eligible for any competitions.
The Goode signs a representation agreement which would adversely affect his amateur eligibility with NCAA if this contract is not intimated to NCAA in prior to next scheduled athletic event. Their contract would be cancelled. There would be legal action against agent and former athlete on behalf of violation of acts which causes damage.
After 13 days of signing of repesentational contract, if Goode wants to cancel the contract with Shady then he can proceed with it. There won't be any impact of cancellation of contract with agent by Goode. This is because it is in the provision of UAAA and NCAA acts.
