Question

In the following case determent if legal action can be taken.

A class of 25 students, is told by their instructor if they leave a lecture early that, he will now start removing 5 points from their total class points. The instructor also locks the classroom door to stop late students from getting in. A student become so upset about the policy that they become stress because they have been point docked at least 5 times and are starting to fail the class, the student quits the class and feels that by locking them in the instructor violated their rights and caused them mental harm with policy that are not part of the school. Can they make a case and win it?

Explanation / Answer

No, they cannot win the case as they have breached the classroom discipline for more than once and it is the part of policy adopted by the school regarding the discipline and proper conduct to be maintained inside and outside of the classroom. Also, the instructor has already communicated the nature and expectations of discipline to be maintained by the class so that the class could deliver optimum performance. The instructor has also communicated the nature of disciplinary action to be taken in the event of violation. Thus, it is the negligence from the students’ side that they could not follow the rule.
Besides, early leaving the class and or late coming to the class, disrupts the rhythm of the class and performance of the whole class is negatively affected. Thus, students cannot win the case as they are guilty of indiscipline.
