In the following questions, determine whether the actor, George, is negligent. If so, indicate that he is negligent. If not, indicate why he is not negligent. If you determined that he is not negligent, indicate which element of negligence is missing.
1. George goes to the gold course on Sunday morning, eager to try out a new set of gold clubs he has just purchased. As he tees off on the first hole, the head of his club flies off and injures nearby golfer.
2. George goes to the golf course on Sunday morning. While he is teeing off at the eleventh hole, his golf ball veers toward a roadway next to the golf course and shatters a car's windshield.
3. Driving down a one-way street in the right direction, at no more than the posted speed limit, George hits a teenager, who is injured. The boy had jumped in front of George's car from behind a stone wall to impress friends by scaring George.
4. Driving on, at the next blind spot in the road, George honks his horn three times to warn any teenager who may be waiting to jump in front of his car. Two blocks way, an elderly woman believes the horn is an air raid siren and suffers a heart attack.
Explanation / Answer
All the four questions indicate that the actor George is negligent.
1) When George is on the Golf course, he should keep certain things in mind. a) He is not the only one on the golf course. There are others as well ( b) When there is some one else on the golf course teeing, George should be more cautious when he is excercising the tee.
Since George wasn't cautious while teeing, the head of the club flew and hit the nearby Golfer. In this case, it was clearly George's negligence.
2) In this case, when George is teeing off at the eleventh hole, the golf ball flew towards the roadway and shattered the car's windshield. This is a case of sheer negligence.
3) George is driving down the street at a posted speed limit. When a teenager comes out of no where just to scare him to impress his friends, and got hit by George's car, then it was the teenager's mistake. And, there is an element of negligence from George's end too. When he is driving, he should be attentive. Anything can come out of anywhere, the driver should be prepared for every circumstance while driving. He could not break the speed, and the teenager got injured. It case also proves that George is negligent.
4) In this case, George was too cautious, which led to an elderly women's death. George honked his car horn three times just to avoid any other teenager who is trying to play the prank of scaring George. But, with his too-cautious approach he killed an elderly lady, who died of heart attack.
All the four cases indicate that the George is negligent.
