Juan Flores, a Medical Doctor (MD) in the Philippines who came to work as a nurse in the United States complains to you that he has been routinely excluded from regular assignments by his supervisor, who instead has assigned him to simple duties on a special AIDS wing of the hospital requiring a relatively low level of nursing skills. Flores is heterosexual, but his supervisor recently asked him if he participated in the Rainbow Gay Pride Parade. Flores recently made a complaint to you about his treatment. What actions do you take, if any, and why? Discuss the issues in a post of at least 200 words

Explanation / Answer

This is a prima facie case of discrimination and a violation of Equal Employment Opportunity (EEO) laws. The organization may incur liability and penalty and hence intervention is required to sensitize the manager of Flores about possible implications and consequences of his acts of discrimination against Flores. Such type of nursing discrimination violates the basic regulations and principles laid down for the health care providers. Flores’s supervisor is clearly in violation of the regulations against blatant discrimination, by singling Flores out assigning him tasks which are not commensurate to his skills or qualifications.

Participation in a rally in support of Gay rights, cannot be ground for discrimination. It’s a constitutional right of the person to support any legitimate cause he or she like to choose. Flores supervisor is wrong at asking Flores about whether he participated in Rainbow Gay Rights Parade. It is a matter of individual choice for Flores.

Therefore the incharge of nursing staff should take appropriate actions to stop nursing discrimination. He should talk to Flores’s supervisor and tell him about the potential discrimination that he is engaging in and the consequences of his acts. If Flores supervisor does not change his ways of dealing with Flores, then appropriate disciplinary action needs to be taken against him.
