The percussion from the explosion causes Jim to fall off of a ladder where he was working four blocks away. Does Acme Construction have a viable negligence claim against Mark for the damage to its construction site? Does Mark have any viable defenses? No, Jim has not a viable claim towards Mark It was not an intentional act and it was an indirect effect. Mark can said it in his defences. And Jim was afraid from the percussion so that it was not the fault of Mark. Jim can not claim anyone that he was excited from the pecussion sound.
