Pamela and her friends, who are residents of California decided to go to Vegas (Nevada) and celebrate her 25th Birthday. They checked into hotel WIN WIN :-) and after sightseeing they decided to go gamble. Pamela was sitting underneath a big chandelier that was installed 2 days prior. However, it was missing 3 screws and the technician failed to firmly secure the chandelier. Pamela was playing on a slot machine directly underneath the chandelier and her friends were nearby playing as well. Suddenly the chandelier broke and fell on Pamela's back, she suffered broken bones, fractured head, broken jaw and she had to undergo various corrective surgeries on her face, Her, medical bills totaled $85,000. Pamela wants to bring an action against WIN WIN for negligence in the Federal court and WIN WIN claims that that there is no Federal Question and the action should be brought to the Nevada or California State court. 1) Can Pamela take her case to the FEDERAL Court? Issue:

Did WIN-WIN have a quality check after the technicians' work to ensure that the chandelier is fit for public use and it would not injure the Pamela?

Rules:

Any gambling facilities within the hotel premises shall not physically harm the visitors or guest. If any accident due to the professional negligence against providing the safety facilities is illegal. Safety related issues can be heard under the federal law. The physical injuries are severe, mere damage or threat to the life of the visitors or guests.

Analysis

There were 3 screw missing in the chandelier,and a major defect, failure to fix the chandelier firmly. That is the reason the chandelier broke and fell on the plaintiff. So causing injuries to the plaintiff. The injuries to the plaintiff was broken bones, fractured head, and broken jaw. The plaintiff had undergone various corrective surgeries on her face for a medical expense of $85,000. These physics injuries were due to the poor condition of the chandelier that was not fit for public usage. But the hotel has permitted the slot machine to be located directly underneath the chandelier that was very poor in quality. The hotel failed to do the appropriate safety measures in the facility.

Conclusion:

Pamela can take her case to Federal court. Pamela can demand compensation for the medical expenses, and other damages due to the hotel WIN-WIN's professional negligence. The hotel WIN-WIN is responsible for the injuries to Pamela.
