Big City, Kansas is a metropolis of more than 1,000,000 people and is in the midst of a growth cycle. However, most of the land adjacent to Big City is not suitable for development so all of the residential and commercial growth is taking place in the surrounding small cities and unincorporated areas in Landon County. In Landon County, east of Big City are the cities of Dole (population 4800) and Carlin (population 2700). Carlin is located two miles east of Big City and Dole is located one and one half miles North of Carlin. Sam Speculator owns one square mile of farm land bordering on the South city limits of Dole, the South border of the land being one half mile North of Carlin. The John Deere tractor company has decided to place a small plant in the southeast corner of Speculator's land.
Carlin contracts with Big City for both sewer and water and has sewer and water lines connecting it to Big City that run North of town to 100 yards South of Speculator's property and then straight West into Big City. Upon the announcement of the plant, Carlin started annexing the small plots of land between it and the plant site.
Dole has its own sewer and water plants. Dole filed a petition with Landon County to be allowed to annex all of Speculator's land, thus beating Carlin to the plant site. Big City, looking at future growth patterns, also filed a petition to island annex all of Speculator's land, based upon the ability to serve with water and sewer. Speculator not wanting his land and the plant site to be part of any city, petitions Landon County to become an Improvement District. He would contract with Big City for any services necessary for the plant.
There is a ten year old development with 450 residents in the unincorporated area half way between Carlin and the plant site. The residents contract with Carlin for sewer and water from the lines into Big City. Landon County maintains the streets in the development and law enforcement is provided by the Sheriff. The residents see Carlin's plans to annex to the plant site and petition Landon County to be incorporated as the city of Solitude.

Emphasis should be given to the procedure and criteria to be used by Landon County in affording the necessary hearing. You will then assume that all of the procedures have been properly complied with and advance arguments supporting your efforts to defend or challenge your assigned petition.
ASSIGNMENT
You will represent the City of Carlin in challenging Speculator's petition to create an improvement district, pursuant to K.S.A. 19-2754 et seq. and 19-270, encompassing Speculator's land and the plant site. Although you are concerned with a petition to create an improvement district, there are similar procedural standards involved in incorporating a city. Therefore, you may also want look at Wichita v. Board of Sedgwick County Comm'rs, 232 Kan. 149, 652 P. 2d 717 (1982) and In re Application for Incorporation as City, 241 Kan. 396, 736 P. 2d 875 (1987). Representatives of the City of Big City and the City of Dole will also be challenging the petition and a representative of Speculator will be defending the petition. A representative of the citizens of the Solitude area will be supporting the petition.
