Question
5. Former Major League Baseball player and radio game announcer Bob Uecker sought an injunction against Ann Ladd, alleging a six- or seven-year pattern of harassment. Ladd, who claimed to be a “devoted fan,” was charged with felony stalking. An injunction was issued against her bothering Uecker, but the stalking charge was dropped when she agreed to cooperate. Later, Ladd sued Uecker for defamation, claiming that Uecker defamed her in the material he filed in support of his applica- tion for the injunction. The trial court dismissed her suit, and she appealed. What do you think the out- come of her appeal was and why? [Ladd v. Uecker, 780 N.W.2d 216 (Ct. App. Wisc. 2010).]
Explanation / Answer
Solution :
It is highly likely that the court will dimiss her appeal . It will be dismissed because Ladd allegation that the Brewers took photographs of her in the stands at baseball parks and disseminated her "mug shot" and information about the injunction and the spring training incident. None of these involved private places, using her likeness for advertising or trade, or depictions of nudity. These events occured at public places and hence does not amount to invasion of privacy . Ann Ladd will loose the appeal .
