Covered nonexempt workers are entitled to a minimum wage of not less than $7.25 per hour effective July 24, 2009. Overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek. In this week's class discussion you will converse with your classmates on questions dealing with calculating overtime pay and holiday pay.

Explanation / Answer

The FLSA protects employees from working many hours without getting paid what is considered fair compensation. A company must pay its employees time and a half pay when working over 40 hours a week. This overtime pay gives workers incentive for working more than 40 hours. The FLSA also protects minors from adverse working conditions. Things such as an hours worked per week limit and mandatory breaks help a minor from getting treated unfairly. The challenges the FLSA presents for employers is all of the compliance measures. COmpanies need to keep detailed records and logs of how many hours each person works. The employer must prove to the FLSA that the company is complying to its standards, are major fines could occur.

The provisions for employees are: entitilement to overtime pay when working over 40 hours, protection from long hours and minimal breaks for minors. The FLSA also sets provisions for who is considered an exempt worker and non exempt worker. Some non exempt workers identified by the FLSA are commisioned sales emplyees, employees paid on salary, farmworkers, and certain seasonal employees.
