Question
Employee A is a member of a group that could fairly be called a White supremacist group. If Employee A never engages in any inappropriate activity at work, should the Employer investigate his social media postings regarding his membership in the group? If the Employer finds something it deems objectionable (but which does not rise to the level of advocating violence), should Employee A’s social media postings affect his employment? Why or why not? If the postings were discovered by other employees who felt uncomfortable working with Employee A after reading the postings, would this change your answer? Why or why not?
Explanation / Answer
Ideally, invading an employee’s personal space is not desirable at a work place unless the Employee’s activities have certain detrimental bearing upon the Professional work or is involved in certain criminal or civil torts or activities that may legally put the employee’s employment at stake. It could be a personal choice to believe in ‘White’s Supremacy’ but as long as that employee does not practice any discrimination between the Blacks and the Whites at the workplace, the whole concept of bothering Employee A only because of his preference towards a social media group, would be rather uncalled for. The same shall not even change if the postings were discovered by other employees who felt uncomfortable working with Employee A after reading the postings because there is a line of difference between developing an interest towards something and practicing the same. The group that he joined in the social media website may not be anti-social in nature that requires a Police investigation upon the same. Moreover, Employee A not even engages in any inappropriate activity at work. Hence the whole idea of stalking his social media posts and making him vulnerable at workplace to open judgments regarding the employee, is itself unethical. My answer shall only change if the Employee A joined a Social media group that is itself illegal and antisocial in nature, such as Terror Organizations, Drug Trafficking groups, etc.
