Thus the US Circuit Court upheld the enforceability of website terms of service by without the click by the user, thus either the user has read it or not, the term of service will be applicable. Earlier, the term of service was applicable post the user click on the agree option.
One positive implication: With this introduction of website term of service, all the users are responsible to abide by the ethical requirements for the website. Thus without the user permission, all user if login on the website, then they are by default responsible for complying the ethical standards. This provides the better platform of ethical standards maintenance at the website level.
One Negative implication: With this rule of website term of service, the websites may add unnecessary/ non-required ethical conditions to be abide by the user.
